These Terms of Service ("Terms") govern your access to and use of the Subtle Asian Treats website at subtleasiantreats.com (the "Site") and the products and services we sell through it (the "Services"). By using the Site or placing an order, you agree to these Terms.

If you do not agree to these Terms, please do not use the Site.

1. About us

Subtle Asian Treats is an online retailer of kawaii plushies, phone cases, and accessories. We operate from Malaysia and ship worldwide. Contact: support@subtleasiantreats.com.

2. Eligibility

You must be at least the age of majority in your country or state of residence to place an order. If you are a minor, you may only use the Site with the involvement of a parent or guardian.

3. Account and security

You are responsible for keeping your account login details secure. Tell us immediately at support@subtleasiantreats.com if you suspect unauthorized access.

4. Orders, pricing and payment

All orders are offers to purchase and are subject to our acceptance. We reserve the right to refuse or cancel any order, including for reasons such as stock availability, pricing errors, payment issues, or suspected fraud. If we cancel an order after payment, we will refund you in full.

Prices are displayed in USD and are subject to change without notice, but the price you pay is the price shown at checkout when you place your order. Payment is charged at the time of purchase. Applicable taxes are calculated and disclosed at checkout where required.

5. Shipping and delivery

See our Shipping Policy for delivery times, customs handling, and lost-package procedures. We accept risk of loss until the order is delivered to you.

6. Returns and refunds

See our Refund Policy for return windows and processes. EU and UK consumers have a 14-day right of withdrawal under the Consumer Rights Directive, without needing to give a reason.

7. Product information

We make every effort to display product colors, sizes, and features accurately. Actual colors may vary slightly due to monitor settings, and all handmade plushies have a natural variance of 2 to 3 cm in measurement. Product descriptions, prices, and availability are subject to change without notice.

8. Consumer rights

Nothing in these Terms limits or excludes the statutory rights you have as a consumer under the laws of your country of residence. Where a term in these Terms conflicts with mandatory local consumer protection law, the local law prevails to the extent required by that law.

  • UK consumers have rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013.
  • EU consumers have rights under the Consumer Rights Directive (2011/83/EU) and Directive 1999/44/EC.
  • Australian consumers have rights under the Australian Consumer Law.

9. Acceptable use

Do not use the Site for any unlawful purpose, to violate intellectual property rights, to distribute malware, to harass or harm others, or to attempt to disrupt or gain unauthorized access to the Site or its systems. We may suspend or terminate access for any breach of this section.

10. Intellectual property

The Site, its original designs, photography, text, and the Subtle Asian Treats brand are our intellectual property. You may not reproduce or redistribute Site content without written permission, except for personal, non-commercial browsing.

11. User-submitted content

If you submit reviews, comments, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Site and our marketing. You are responsible for making sure your content doesn't violate anyone else's rights.

12. Third-party links and tools

The Site may link to third-party websites or use third-party tools we don't control. We're not responsible for the content, accuracy, or practices of third parties. Your use of third-party services is at your own risk and subject to their own terms.

13. Disclaimer of warranties

Except where prohibited by law, the Site and Services are provided "as is" without warranty of any kind. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. This does not affect your statutory rights as a consumer.

14. Limitation of liability

To the fullest extent permitted by applicable law, our total liability arising from or in connection with your use of the Site or the Services is limited to the amount you paid for the order in question. We do not exclude or limit liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be excluded under applicable law. Consumer statutory rights are not affected by this clause.

15. Governing law

These Terms are governed by the laws of Malaysia, without prejudice to the mandatory consumer protection laws of your country of residence. Any dispute should first be raised with us at support@subtleasiantreats.com so we can try to resolve it directly.

16. Changes to these Terms

We may update these Terms from time to time. The current version is always posted on this page with the "last updated" date above. Your continued use of the Site after an update means you accept the updated Terms.
